Judge : A U.S. judge issued a verdict opposing a program that provides deportation relief and work permits to individuals brought to the country without legal authorization as children, commonly referred to as “Dreamers.”
This judgment comes despite efforts by President Joe Biden’s administration to strengthen the program’s legal foundation through a new regulation.
The ruling, made by U.S. District Court Judge Andrew Hanen in Texas, represents a recent setback for the Deferred Action for Childhood Arrivals (DACA) program. It affects not only the programs Half a Million current enrolees, but also other immigrants who had hoped for approval under its provisions.
Judge Andrew Hanen & DACA Program
Judge Andrew Hanen, who was appointed by the Republican Party, has determined that a regulation introduced by President Biden’s administration last year does not address the legal shortcomings that led him to declare the DACA program illegal in 2021 and prevent any expansion of the program.
DACA, which has been in operation for over a decade, provides relief to immigrants brought to the U.S. as children. Judge Hanen has ruled that the U.S.D.H.S can continue with their renewing procedure for individuals who were enrolled in DACA before his 2021 decision.
Hanen clarified that the order does not compel U.S. immigration authorities to take any immigration enforcement, deportation, or criminal action against DACA recipients, applicants, or any other individuals who would not otherwise be subject to such actions.
