India Mandates: The Law Commission, led by Justice Ritu Raj Awasthi, has urged the Union Government to mandate the compulsory registration of all marriages between non-resident Indians (NRI) or overseas citizens of India (OCI) and Indian citizens.
This recommendation comes in response to the escalating cases of fraud, including abandonment and misrepresentation, in such unions.
India Mandates Registration
Prompted by the surge in deceptive marriages, particularly endangering Indian spouses, especially women, the Law Commission was tasked in November to review and enhance regulations governing NRI/OCI and Indian citizen marriages.
The Commission emphasized the necessity of addressing gaps and issues within the current legal framework contributing to these problems.
The proposed measures advocate comprehensive central legislation encompassing divorce proceedings, child custody, maintenance, and serving of legal documents.
Notably, the recommendation includes granting jurisdiction to domestic courts to adjudicate disputes, thereby safeguarding the rights and interests of both parties involved.
By compelling the registration of NRI/OCI-Indian citizen marriages and instituting robust legal provisions, the aim is to curtail fraudulent practices and provide recourse for aggrieved parties.
Such initiatives align with the broader objective of ensuring transparency and accountability in marital unions, fostering trust and security within cross-border relationships.
As the government considers implementing these recommendations, it underscores a commitment to address the complexities and challenges inherent in international marriages, promoting justice and protection for all parties involved.
