EB-5 Visa Amidst : In an era of increasing challenges surrounding H-1B visas in the United States, Indians are charting a new course towards stability and opportunity through the EB-5 visa program. With layoffs and uncertainties plaguing H-1B visa holders, many are finding solace in the EB-5 Investor visa, viewing it as a viable solution to their immigration and employment concerns.
The EB-5 Investor visa is designed for foreigners who invest a minimum of Rs.6.6 crores in a project that creates employment for at least ten individuals in the United States. This avenue holds particular appeal for those with children studying or aspiring to study in America, as well as those seeking a dependable pathway to a green card.
EB-5 Visa Amidst also Includes Concurrent Filing
The allure of the EB-5 visa is not only rooted in its investment-based approach but also in recent legislative changes. The Reform and Integrity Act, introduced last year, has accelerated the shift towards the EB-5 visa. This legislation permits concurrent filing, allowing applicants to apply for a green card simultaneously with their EB-5 visa. Additionally, it offers the convenience of transitioning visa status to a green card through the I-485 application process.
This groundbreaking legislation significantly expedites the process. Applicants can secure the Employment Authorization Document (EAD) necessary for working in the United States within six months, providing them with the freedom to earn income without fear. Furthermore, this flexibility allows investors to adapt or change companies as needed. Abhinav Lohia, the Global Managing Director of EB-5 Regional Centre, Golden Gate, notes that even after obtaining advance parole, EB-5 investors can travel to India multiple times without hindrance.
Nicholas A. Mastriani, President of the US Immigration Fund, clarifies that only individuals with authorized visa status within the United States are eligible for concurrent filing. He highlights that the temporary work permit, issued after the visa adjustment application, has a two-year validity, with the possibility of renewal, enabling applicants to seek employment or operate as independent contractors in the United States.
With the uncertainty of layoffs looming over H-1B visa holders, many are exploring alternative routes, such as student visas or transitioning to visitor visas. However, the EB-5 visa’s concurrent filing option provides a lifeline, eliminating the pressure of securing another job within 60 days. Lohia emphasizes that this unique opportunity allows investors to sustain their presence in the United States with confidence.
